Acceptance of These Terms of Service

Animeblip ("we," "us," or "our") provides our services (described below) and related content to you through our website(s) located at animeblip.com (the "Site") and through our mobile applications and related technologies ("Mobile Apps," and collectively, such Mobile Apps and the Site, including any updated or new features, functionality, and technology, the "Service"). All access and use of the Service is subject to the terms and conditions contained in these Terms of Service (as amended from time to time, these "Terms of Service"). By accessing, browsing, or otherwise using the Site, Mobile Apps, or any other aspect of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not accept the terms and conditions of these Terms of Service, you will not access, browse, or otherwise use the Service.

We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these Terms of Service were last revised. You may read a current, effective copy of these Terms of Service by visiting the “Terms of Service” link on the Site and under the “Terms of Service” section of our Mobile App. We will also notify you of any material changes, either through the Service user interface, a pop-up notice, email, or through other reasonable means. Your continued use of the Service after the date any such changes become effective constitutes your acceptance of the new Terms of Service. You should periodically visit this page to review the current Terms of Service so you are aware of any revisions. If you do not agree to abide by these or any future Terms of Service, you will not access, browse, or use (or continue to access, browse, or use) the Service.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THE AGREEMENT TO ARBITRATE REQUIRES (WITH LIMITED EXCEPTION) THAT YOU SUBMIT CLAIMS YOU HAVE AGAINST US TO BINDING AND FINAL ARBITRATION, AND FURTHER (1) YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST ANIMEBLIP ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, (2) YOU WILL ONLY BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ON AN INDIVIDUAL BASIS, AND (3) YOU MAY NOT BE ABLE TO HAVE ANY CLAIMS YOU HAVE AGAINST US RESOLVED BY A JURY OR IN A COURT OF LAW.

At Animeblip, we respect the privacy of our users. For more information, please see our Privacy Policy, located at animeblip.com/privacy-policy. By using the Service, you consent to our collection, use, and disclosure of personal data and other data as outlined in the Privacy Policy.

Additional Terms:

In addition, when using certain features through the Service, you will be subject to any additional terms applicable to such features that may be posted on or within the Service from time to time. All such terms are hereby incorporated by reference into these Terms of Service.

Submission of Content:

Animeblip is always looking for talented creators and content. To the extent you submit a story, animation, or other material for our review, these materials are reviewed on a rolling basis. We strive to review and respond to all submissions, but due to the volume, you may not receive a response. If we are interested in working with you, we will contact you via email. By submitting your work to Animeblip, you do not transfer any copyrights to your work. All work remains yours.

Access and Use of the Service

Service Description:

Animeblip is designed to provide users with a platform for watching and interacting with short-form anime content and AI-generated anime summaries of manga chapters, featuring content from creators, along with unique storytelling experiences.

Your Registration Obligations:

To access certain features of the Service, you may be required to register and provide information about yourself (e.g., name and email address). You agree to provide true, accurate, current, and complete information about yourself as prompted by the registration form. If you are under 13 years of age, you are not authorized to use the Service. If you are under 18, you may use the Service only with express consent from a parent or guardian.

Member Account, Password, and Security:

You are responsible for maintaining the confidentiality of your account and password details. You agree to notify Animeblip immediately of any unauthorized use of your account. We are not liable for any loss arising from your failure to comply with this.

Modifications to Service:

Animeblip reserves the right to modify or discontinue the Service at any time without notice.

General Practices Regarding Use and Storage:

You acknowledge that Animeblip may establish general practices regarding the use of the Service, including content retention and storage limits. We are not liable for the deletion or failure to store any data or content uploaded by you.

Conditions of Access and Use

User Conduct:

You are solely responsible for all code, video, images, information, data, text, software, music, sound, photographs, graphics, messages, and other materials ("content") that you make available to Animeblip, including by uploading, posting, publishing, or displaying (hereinafter, “upload(ing)”) via the Service or by emailing or otherwise making available to other users of the Service (collectively, “User Content”). Animeblip reserves the right to investigate and take appropriate legal action against anyone who, in Animeblip’s sole discretion, violates this provision, including removing the offending content from the Service, suspending or terminating the account of such violators, and reporting the violator to law enforcement authorities.

Fees and Payment:

If you subscribe to any portion of the Service that is fee-based, you will need to provide payment information. You are responsible for paying the fees associated with your subscription, and you agree to notify Animeblip of any changes to your billing information.

Commercial Use:

Unless otherwise expressly authorized herein or in the Service, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, grant access to, transfer, or otherwise use or exploit any portion of the Service for any commercial purposes. The Service is for your personal use.

Mobile Services and Software

Mobile Services:

The Service includes certain services that are available via a mobile device, including (i) the ability to upload content to the Service via a mobile device, (ii) the ability to browse the Service and the Site from a mobile device, and (iii) the ability to access certain features and content through Mobile Apps (collectively, the “Mobile Services”).

Mobile App License:

Subject to these Terms of Service, Animeblip hereby grants to you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to (a) install the Mobile App on one mobile device and (b) use the Mobile App for your own personal use solely to access and use the Service.

Ownership; Restrictions:

The technology and software underlying the Service or distributed in connection therewith are the property of Animeblip, its affiliates, and its licensors (including the Mobile Apps, the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software.

Notice for International Use; Export Controls:

Animeblip is not currently a registered company. The Service is provided internationally, and you are solely responsible for ensuring compliance with the laws of your specific jurisdiction. Software available in connection with the Service and the transmission of applicable data, if any, is subject to export controls applicable in your jurisdiction.

Intellectual Property Rights

Service Content:

You acknowledge and agree that the Service may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret, or other proprietary rights and laws. Except as expressly authorized by Animeblip, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Service or the Service Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined below) that you upload to or make available through the Service in accordance with these Terms of Service.

User Content:

You are responsible for the content you upload, post, or otherwise make available through the Service ("User Content"). Animeblip reserves the right to investigate and take appropriate action against users who violate the terms of this policy. This includes removing offending content and suspending or terminating the accounts of violators.

Intellectual Property Rights:

Animeblip respects intellectual property. Some content on the platform is AI-generated, and the AI-generated summaries of manga chapters do not constitute Animeblip’s IP. These summaries are created based on publicly available manga, and we will not monetize the original manga chapters themselves. Some content is created in partnership with creators, with rights to publish these works (which may or may not be exclusive) on the platform.

By submitting content to Animeblip, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, display, and distribute your content as part of the Service. You acknowledge that any content from a partnership may be used and shared globally through the platform.

Trademarks:

The Animeblip name and logos are trademarks and service marks of Animeblip (collectively, the “Animeblip Trademarks”). Other Animeblip, product, and service names and logos used and displayed via the Service may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to Animeblip.

Third-Party Material:

Under no circumstances will Animeblip be liable in any way for any content or materials of any third parties (including users), including for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content.

Copyright/Fair use Disclaimer

This platform may feature content based on publicly available anime and manga material. All such content is for educational, entertainment and non-commercial purposes only. We are not monetizing from this content or distributing the original content. We do not claim ownership of any third-party intellectual property of the original works. All rights to the original anime and manga content remain with their respective creators and copyright holders. This platform does not infringe on copyrights, and we operate in accordance with the Fair Use Doctrine to provide value-added content for discussion and education.

The use of copyrighted content is intended for "fair use" under section 107 of the Copyright Act of 1976 for purposes like criticism, commentary, transformative, research, and education. Fair use is a use permitted by copyright statute that might otherwise be infringing.

We strongly encourage our users to support the original creators by visiting the official websites of the manga and anime featured in our app. By promoting and directing users to the original content, we aim to foster a positive relationship with the community and help support the creators behind the works.

All content uploaded to Animeblip remains the intellectual property of the original content creators, unless explicitly acquired by Animeblip. It is your responsibility to ensure that you have the necessary licenses and permissions to upload such content. If your artwork is based on an existing story or intellectual property, you must obtain the permission of the original author or rights holder before uploading it.

Whenever possible, if we are able to locate the original source or creator of the work, we will reach out to confirm whether they are comfortable with their work being adapted by a fan on Animeblip. However, the responsibility to ensure that proper rights and permissions are in place lies solely with the uploader. If you have any concerns about content, let us know at hey@animeblip.com

Licensing

Except where otherwise explicitly stated, content uploaded by users to Animeblip may be made available under a Creative Commons Attribution-Share Alike License 4.0 International (CC BY-SA 4.0). This allows others to remix, tweak, and build upon the content for any purpose, even commercially, as long as they credit the original creation and license their new creations under the same terms.

However, some content may use other licenses based on agreements with content creators or copyright holders. The license applicable to specific content will be clearly indicated within the platform or at the point of upload.

Note: Content owned or licensed exclusively by Animeblip, including content for which Animeblip has obtained commercial distribution rights, is not permitted to be redistributed commercially by any user or third party. Any such content is protected under the specific terms agreed upon by Animeblip and the content owner, and cannot be used or redistributed for commercial purposes without explicit permission.

If a specific piece of content is not explicitly permitted to be used under an alternate license, it will automatically default to the CC BY-SA 4.0 license. Non-permitted uses of content under alternate licenses automatically default to the CC BY-SA 4.0.

Third-Party Services and Websites

The Service may provide links or other access to third-party services. These Third-Party Services are governed by their own terms and privacy policies. You agree to comply with any applicable terms when using third-party services via Animeblip

Indemnification

You agree to defend, indemnify, and hold harmless Animeblip, its affiliates, and its officers, employees, directors, service providers, licensors, and agents from any and all losses, damages, expenses, rights, claims, actions of any kind, and injury arising out of your use of the Service.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee the Service will meet your expectations or that it will be free from errors.

Limitation of Liability

Animeblip’s liability is limited to the amount you have paid for the Service in the last six months. We will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Dispute Resolution by Binding Arbitration

By using the Service, you agree that all disputes will be resolved through binding arbitration. You waive the right to a trial by jury and agree to resolve any disputes individually, not as part of a class action.

Termination

Animeblip reserves the right to suspend or terminate your access to the Service if you violate these Terms of Service. Termination may occur without prior notice, and you agree to not hold us liable for any termination.

General

These Terms of Service constitute the entire agreement between you and Animeblip governing your use of the Service. These Terms will be governed by the laws of the jurisdiction where the company operates.
